JSHosts is a provider of internet related services such as Web Hosting, Reseller Hosting and Virtual Private Servers. The client may from time to
time, require such services. This agreement sets out the terms which have been agreed between JSHosts and the Client for the provision of such
internet services and shall be supplemented from time to time by schedules setting out specific details of such services requested by the client.
JSHosts takes no responsibility for any damages or losses the client may suffer from using our service(s). Client also agrees that JSHosts takes no
responsibility for any data that is contained within the client's personal directories; however client assumes full responsibility of the data.
JSHosts will use reasonable efforts to supply a continuous, uninterrupted service. However, JSHosts is not liable for any loss of data resulting from
delays outside of our control, missed or non-deliveries, service interruptions or by errors or omissions of the customer. JSHosts is not responsible for
any losses suffered resulting from acts of god or force majeure including civil unrest, riots, floods, drought, fire, war and imposing legislation.
You agree that JSHosts is not liable to you for any special consequential damages which you may suffer as a result of loss of business, contracts,
profits, savings or otherwise. JSHosts is unable to exercise control over material sent over the internet and excludes all liability of any kind for the
publication by the Client of inaccurate, misleading, offensive, threatening or obscene material, or material that is in breach of UK or other applicable
law.
Disallowed Content
The services provided by JSHosts can only be used for lawful purposes. Storage or transfer of illegal data is strictly prohibited. It is the clients
responsibility to ensure all content stored on their hosting space, VPS or Dedicated Server conforms to UK law.
We do not allow websites that;
- Contains hateful material or content that incites hate;
- Contains images, videos or descriptions of pornography which is unlawful in the UK;
- Contains warez, unlicensed or copyrighted material; or
- Does not conform to UK law.
Resource Usage / Scripts
Any client that is found to be using software or scripts that are not written in an efficient manner, and at the sole discretion of JSHosts seen to be
consuming excessive amounts of CPU/RAM/Disk, will be asked to either optimize, remove the script in question, or migrate to a VPS/Dedicated Server
where more resources are allowed. JSHosts reserve the right to disable access to any script/website that causes interruptions or problems for our clients.
It is the clients responsibility to ensure that all software on their website is kept up to date, and that the latest security patches and updates are applied
This ensures that your website is free from vulnerabilities that could cause your account to violate our terms of service.
Additionally we do not allow our databases to be used as an external database server for another host or server. Should you wish to do this, you should
migrate to/or use a VPS/Dedicated Server.
IRC Related Services
We do not allow IRC connections to the networks EFNet and/or Undernet. This includes but is not limited to: "IRC servers", "bots", "bouncers" and
"eggdrops". The purpose of this restriction is to prevent attacks to our network, due to the malicious activity known to occur on these particular IRC
networks.
Bulk Emails
JSHosts do not permit bulk email to be sent through our servers. We do not allow more than 250 emails to be sent to recipients at any one time.
Any client that wishes to send more than this limit, must contact JSHosts prior to sending emails with a sample of the content they wish to send.
Unsolicited email is not permitted and will result in immediate account termination.
Account Backups
JSHosts perform daily backups of all shared hosting and reseller hosting accounts. These backups are for our own internal use, however if the client
requires a backup to be restored, we may do this from time to time.
We do not take backups of Virtual Private Servers or Dedicated Servers as the client is responsible for taking their own backups.
We recommend that all clients take regular backups, which can be performed from within your control panel. JSHosts will not be held responsible for any
loss of data.
Payments and Billing
JSHosts will not activate any service(s) until the client has paid in full. You will continue to be invoiced on a recurring basis unless you notify JSHosts of
your desire to cancel any or all services received. Clients must make appropriate payment for the services obtained from JSHosts before or on the due
date of the invoice.
Invoices are generated 7 days before the due date. Payment must be made by the due date to avoid the suspension of your account. If no payment is
received, your account will be suspended 5 days after the due date. If no attempt is made within the next 10 days to pay due invoice(s), we reserve the
right to permanently terminate your account and format all data held.
Bandwidth Overage Charges
Should you exceed your allotted bandwidth limit, we charge a fixed fee of £0.25 per GB used. If you require additional monthly bandwidth, please contact
us to have this arranged prior to exceeding your limit.
Cancellations and Refunds
Clients are able to cancel their services with us at any time through the client area, or by opening a support ticket. Before submitting a cancellation request
it is the clients responsibility to take a backup of all important data. Once an account is cancelled we will not be responsible for any loss of data.
We do not have a minimum cancellation notice for our Web Hosting, Reseller Hosting or Virtual Private Servers. However, we do require a 30 day notice
for Dedicated Server cancellations.
We do not provide refunds for domain names, virtual private servers, dedicated servers, administrative fees or software licenses.
Only first time clients are eligible for a refund. If you have signed up with us before, closed your account then signed up again, you cannot request a refund.
Money Back Guarantee
All subscribers of shared and reseller hosting plans carry a 14 day unconditional money back guarantee. If you find the services to be deficient or
unsatisfactory, you are entitled to a full refund, minus any fees within the first 14 days of the date of account registration.
To request a refund under our money back guarantee, you must contact us within the first 14 days of your account registration. Any requests after this time
will be denied unless otherwise agreed with JSHosts.
Contravention of our Terms of Service
Any client that breaches our terms of service, will be notified immediately by email. The client will be given a maximum of 48 hours to remove the offending
content, then to contact us once this has been completed. After 48 hours if the client has not removed the offending content, their account will be suspended
until they contact us.
In the event of a serious breach of the terms of service, we reserve the right to immediately suspend or terminate the clients account without refund.
